These Terms of Use (“Terms”) govern your access to and use of Poptoon, an entertainment app operated by toemtech (“we,” “us,” or “our”).

By using Poptoon, you agree to these Terms.

If you do not agree, do not use the app.

1. Service Description

Poptoon provides short-form episodic animated stories and related entertainment features, which may include:

Series and episode browsing
Short-form animated or video episodes
Viewing history and watch progress
Free and paid episodes or content
Virtual credits, gems, or similar in-app currency, if offered
In-app purchases
Content recommendations or discovery features
Notifications and other app features

Poptoon is provided for entertainment purposes.

Some stories may include fictional violence, romance, suspense, mature themes, or other content that may not be suitable for all users.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country, whichever is higher.

If you are under the age of majority in your country, you may use the app only with permission from a parent or legal guardian.

By using the app, you confirm that you meet these requirements.

3. Accounts

You may need an account to access certain features.

You are responsible for:

Maintaining the security of your account
Keeping your login credentials confidential
All activity that occurs under your account
Providing accurate account information

4. Entertainment Content

Poptoon contains fictional stories, characters, dialogue, situations, and other entertainment content.

Content may include dramatic, exaggerated, fictional, or unrealistic events.

You should not treat fictional content in Poptoon as professional, legal, medical, financial, emergency, psychological, or other professional advice.

We may add, remove, modify, reorder, replace, or discontinue stories, episodes, artwork, video, audio, features, or other content at any time.

5. AI-Assisted or Generated Content

Some stories, artwork, animation, video, audio, dialogue, subtitles, promotional materials, or other content available through Poptoon may be created, edited, or assisted using artificial intelligence or other automated tools.

AI-assisted or generated content may contain:

Visual artifacts
Continuity errors
Inaccuracies
Inconsistencies
Unexpected or imperfect outputs

We do not guarantee that all content will be factually accurate, realistic, error-free, or free from creative inconsistencies.

Poptoon is an entertainment service, and AI-assisted or generated content should be understood in that context.

6. Purchases, Virtual Credits, and Paid Content

Some episodes, content, features, or virtual items may require payment or virtual credits.

Purchases may be processed through the applicable app store, such as Apple App Store or Google Play, and/or through purchase-management providers such as RevenueCat.

We do not directly process or store your full payment card information.

6.1 Virtual Credits

If Poptoon offers virtual credits, gems, coins, or similar in-app currency:

They are licensed for use only within Poptoon.
They have no cash value except where required by applicable law.
They cannot be redeemed for cash.
They may not be transferred, sold, or exchanged outside the app unless we expressly allow it.
They may be used to unlock eligible episodes, content, or features as described in the app.
The amount required to unlock content may change from time to time.

Virtual credits are not a bank account, stored-value account, or financial product.

6.2 Paid Episodes and Content Access

Certain episodes or other content may be free, while others may require virtual credits or another form of paid access.

The availability, price, credit cost, or access rules for content may change from time to time.

Unlocking or purchasing access to content generally grants you a limited, personal, non-transferable right to view that content through Poptoon, subject to these Terms and applicable law.

6.3 Refunds

Billing, cancellation, and refunds are generally handled through the applicable app store or payment provider.

We do not control app store refund decisions.

Refunds are subject to the policies of Apple, Google, or the applicable payment provider, except where applicable law provides additional rights.

6.4 Subscriptions

If Poptoon offers subscriptions in the future or in certain regions, subscription terms, billing periods, renewal rules, and cancellation options will be shown at the time of purchase.

7. Acceptable Use

You agree not to:

Use the app for illegal, harmful, fraudulent, or abusive purposes
Harass, threaten, or harm others
Violate the rights of others
Attempt to reverse engineer, copy, scrape, or misuse the app
Circumvent payments, virtual credit requirements, usage limits, rate limits, or access controls
Interfere with the operation, security, or availability of the service
Attempt to access accounts, data, systems, or content without authorization
Use bots, scripts, automation, scraping tools, or other methods to extract or reproduce app content without permission
Copy, record, download, redistribute, republish, resell, or commercially exploit app content except as expressly permitted
Use the app in a way that violates applicable laws or regulations
Resell, redistribute, sublicense, or commercially exploit the app without permission

8. User Submissions

Poptoon may allow you to provide feedback, support requests, profile information, reviews, messages, or other information (“User Submissions”).

You retain any rights you have in your User Submissions.

By providing User Submissions, you grant us a limited, worldwide, non-exclusive license to process, transmit, store, reproduce, and use them only as reasonably necessary to:

Provide and operate the app
Respond to support requests
Maintain and secure the service
Improve app functionality
Comply with legal obligations

You are responsible for your User Submissions and for ensuring that you have the right to provide them.

9. App Content and Intellectual Property

The app and its content are owned by us or our licensors, as applicable, including:

Series
Episodes
Stories
Characters
Scripts
Dialogue
Video
Animation
Audio
Music and sound effects
Artwork
Thumbnails
Images
Subtitles
Metadata
Promotional materials
Designs
Software
Trademarks
UI elements

Poptoon may also include content licensed from third parties. Rights in such content remain with the applicable owners or licensors.

You may use the app and its content only for personal, non-commercial entertainment purposes unless we give you written permission otherwise.

You may not copy, reproduce, extract, redistribute, resell, publicly display, publicly perform, republish, modify, create derivative works from, or commercially exploit app content except as permitted by law or with authorization from the applicable rights holder.

No ownership rights in app content are transferred to you through your use of Poptoon or through the purchase or unlocking of content.

10. Third-Party Services

The app may rely on third-party services, including:

Supabase
Firebase
RevenueCat
Apple
Google
Hosting, storage, content-delivery, analytics, security, or other infrastructure providers

Your use of the app may also be subject to the terms and policies of those third-party services.

We are not responsible for third-party services, outages, processing, policies, data handling, or decisions outside our reasonable control.

11. Service Availability

We may modify, suspend, limit, or discontinue any part of the app at any time.

We do not guarantee uninterrupted, error-free, or always-available service.

Video delivery, content storage, payment, authentication, analytics, notification, and other features may depend on third-party systems and may sometimes fail or be unavailable.

We do not guarantee that any particular series, episode, feature, or item will remain available indefinitely.

12. Termination

We may suspend or terminate your access to the app if:

You violate these Terms
You misuse the service
You attempt to circumvent payment or access restrictions
Your use creates risk for us, our licensors, or other users
We are required to do so by law
We discontinue the service or relevant features

You may stop using the app at any time.

You may request account deletion as described in our Privacy Policy.

To the extent permitted by applicable law, termination or account deletion may result in loss of access to app data, viewing history, or unused virtual items associated with your account.

13. Disclaimers

The app is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of:

Accuracy
Reliability
Availability
Fitness for a particular purpose
Non-infringement
Error-free operation

We do not guarantee:

That all content will be available at all times
That playback will always be uninterrupted
That content will be free from errors, artifacts, or inconsistencies
That a particular series or episode will remain available
That the app will meet your personal preferences or expectations

14. Limitation of Liability

To the fullest extent permitted by law, toemtech will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including:

Loss of data
Loss of profits
Loss of goodwill
Service interruptions
Playback failures
Content availability changes
Loss of viewing history
Unauthorized access outside our reasonable control
Errors or inconsistencies in app content

Our total liability for any claim related to the app will be limited to the amount you paid to use the app during the three months before the claim arose, or USD $50, whichever is greater, unless applicable law requires otherwise.

15. Privacy

Your use of the app is also governed by our Privacy Policy, which explains how we collect, use, store, and share information.

16. Mandatory Local Rights

These Terms do not limit any mandatory consumer protection, privacy, cancellation, refund, or statutory rights you may have under the laws of your country.

If a provision of these Terms is unenforceable in your location, the remaining provisions will continue to apply to the fullest extent permitted by law.

17. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify you through the app, by email, or by updating the effective date above.

Your continued use of the app after the updated Terms become effective means you accept the updated Terms, to the extent permitted by applicable law.

18. Governing Law

These Terms are governed by the laws of Republic of Korea, unless mandatory consumer protection laws in your country require otherwise.

If you are located in a country with mandatory consumer protection or data protection laws, those rights are not limited by these Terms.
